The People v. Dlugash case was about a man named Melvin Dlugash who was convicted in the Supreme Court located in Kings County, Brooklyn of murder, however; the verdict was reversed and dismissed. According to Jasen J., The Court of Appeals, the reasons why his verdict was dismissed because there was not enough evidence to prove that it was murder, the victim was alive when he was shot, and he couldn't be charged with attempted murder. This case took place on May 12, 1977 at the Court of Appeals and the other reason for this because there was no legal sufficient evidence to establish that it really was murder, so it sufficient enough to reduce it to attempted murder. There are various definitions of the word, "murder", for example, homicide means to sustain homicide conviction and it must be established beyond the reasonable doubt that the defendant actually caused the death of another person. The defendant has admitted to firing five shots into the victim two to five minutes after someone else had already shot him. The victim who was killed was a man named Michael Geller, a 25 year old man who was shot to death on December 22, 1973 in his bedroom apartment in Brooklyn. His lifeless body was filled with bullets when he was shot seven times in the face and head lying on his back. Regardless of the reasons why this young man was murdered, it does not give anybody the right to take someone else's life.
The definition of the word, "crime" is when it is committed by someone with the intention to cause harm to another person or their property. It can occur when a law is broken by an action, omission, or neglect that can lead to punishment, whether the person has to spend some time in jail, be put on probation, or pay a fine. There are two ways that a crime can be committed whether it is destroying someones property or being violent towards someone, for instance, assaulting a person for the purpose to rob them and forcing someone to have sex against their will, also known as sexual assault and attempted rape. Omission can also be crime when an individual runs a red light and a stop sign that can be a lot of people in danger of getting seriously hurt or killed. It can also mean taking a person's medication with the intention to make him or her seriously ill, this is considered abuse and it is also a crime to neglect a child whether it is educational, medical,etc. If someone suspects that a child has been abused by a parent or a caregiver they have to report it or they will get in serious trouble for not doing anything they can to protect the child or other children involved in that situation. There are Federal, State, and Local Laws to protect American Citizens from so many crimes, so society can make decisions on what is and not considered a crime through the system of laws. It is divided into three sections of systems. The Federal Laws are constantly passed by the United States Congress that are divided into two sections, House of Representatives and Senate. State Laws can be passed by elected legislators that are also known as lawmakers that can vary from state to state. Local Laws are usually known as ordinances or it can be passed by the local county or city government that commissioners and councils. The other part of this definition has something to do with being ignorant to the law, meaning that some people can have the intention to break the law, but it is not always like that. Most of the time a lot of people are not aware of certain things that can be considered a crime such as the ban on using a cell phone while driving. If some people are not aware of this ban on talking on their cell phones while operating their automobiles, they can still be held accountable for breaking that law whether they knew about it or not.
